(Bad Faith) – The insurance company had a 100k policy limit and repeatedly refused my request to settle my client's case for the 100k policy limit. Initially, I sent them all my client's medical records and they initially offered him $38,000.00. Thereafter, I sent them every requested document/information and again requested the 100k but they only offered $45,000.00 as their highest take-it-or-leave-it-offer. Well, we didn't take it and rightfully so.
All throughout my pleading with the insurance company to do the right thing and pay my client the 100k policy limit, I kept informing them that he needs surgery to correct his sustained neck disc herniations injuries and he's definitely going to have the neck surgery in the very near future. Needless to say, the insurance company didn't heed my warnings and the thirty days deadline for them to pay my client the 100k policy limit expired. A month later, my client had the neck surgery and now this small case isn't so small anymore AND it's too late for the insurance company to accept my initial 100k offer to settle.
In Georgia, this is a classic example of an insurance company acting in "Bad Faith," since the insurance company negligently and in bad-faith refused every earlier opportunity to settle the case for the 100k policy limit. We aggressively pursued onward for justice and my very deserving client received a $1,100,000.00 settlement.
